TOPIC: I found a truck

RE:I found a truck 14 Sep 2006 14:03 #16

i've made small batches of bio, i'm getting ready to process 20 gal a week with in the next week. i have alot of work on the house to do so i haven't had the time, oh yeah and i was underway for the summer. i just got home.
we heat with oil and wood so the biodiesel will work out nicely, even easier than burning wood.

currently i have jet fuel in it... jp-5, basically a really clean kerosene with a deicing additive.

the only thing i don't mess with is dyed fuel, the chance of getting pulled over and having to pay the $10k fine is not worth it. if only i could invent something to get rid of the dye...

DOT doesnt dip non commercial vehicals out this way, but I suppose it coul dhappen. I've heard of them walking around parking lots at sales dipping trucks. Im sure they wouldnt tae kindly to finding veggie oil either =] The state of Penn apparently ran out of diesel last year. When we filled up we were given dyed fuel, and a notorized letter from the state that was to be shown to anyone questioning the fact we had off road fuel in our truck. Never had to use it however. It took months to get the dye out of the fuel system.

According to the Constitution the Federal goverment only has the right to regulate interstate commerce. Thats as far as the feds can go. Every federal law is based on it. DOT is Federal. But i still cant fiure it out. There is another form of federal law too. It applys to Corporations. Since corporations are created by the government, the goverment can regulate them however they want. Contractual law is a bugger. I dont participate =]

In DelaWHERE all pickup trucks get a "c" tag regardless of use. I think it's based on GVWR over 5000lbs. So most big SUVs might also get a c-tag.

It does vary from state to state but the average concensus is like Tom said:

5500lbs and under is classed as a "passenger vehicle"
5501lbs and over is classed as a "commercial vehicle"

it also may be better in a business situation to classify the vehicle as "commercial" for a better tax right off at years end. As well in some states you aren't required by law to wear a seat belt if in a commercial vehicle.

and seeing what the basic passenger vehicle weight limit is, I would feel safe to say that most farriers will always weigh in at the 5501 and over mark.

A US DOT officer can pull anyone over at anytime to check weight or type of fuel in the tank. Although unlikely to pull over a pick up truck, if theres an anvil hanging off the backend and the bumpers are dragging the ground then there is suspicion & probable cause. :D

If you're using your vehicle to make more money than $600 a year, then I believe your vehicle is commercial. Whether or not you tag it as such is up to you or your state. In Ohio, you have to request commercial tags for pick-ups no matter what size (1 ton and lower anyways). If you check your insurance policy you may find out that if you don't have commercial tags and your truck is totalled and much of your shoeing tools are damaged, the insurance may not cover the damages if you don't have it licensed and insured as a commercial vehicle. If you carry liablity or a tool and equipment policy, it may also be void if the vehicle is not registered as commercial. Alot of fine print you may need to go over with your insurance company.

You can also write off the registration of the vehicle if it's tagged commercial.

Don't come to Texas in a commercial vehicle or in anything that a friendly Texas Dept of Public Safety CVE(commercial vehicle enforcement) Trooper would consider to be commercial or used for commercial purposes.

You will reconize them they will get out wearing a tan uniform wearing a cowboy hat and will soon be changed into coveralls unloading truck scales and a creeper to do that DOT inspection on your vehicle. Most of them will let you sit in the A/C in their trucks while they write you some citations for those flagrant violations on your shoeing rig while waiting on the wrecker to remove that unsafe vehicle from a Texas roadway.

Press hard there are four copies.

I wouldnt tollerate that kind of Gustopo ****. It would be near impossable tfor them to win in court (especially if you from out of state) unless you had a CDL or you were somehow contractualy bound to the those regulations by other means. I hate it when they revinue.

Come on down, the interstate runs in and out of Texas.

If they stop you make sure and tell them about the gustapo revenue deal and how they won't win any court decision since your from out of state and don't have a CDL.

I'll be looking for the supreme court updates. :D

Relative to driver licensing, Texas has reciprocity with other states and political entities: You can legally drive in Texas with a New Yawk driver's license and it's good for whatever class vehicle it is in New Yawk. But, there's no reciprocity when it comes to vehicles using Texas roads. Every vehicle on public roads within the state that is owned by non-governmental entities is subject to Texas laws concerning licensure, insurance, safety, dimensions, etc.

Jeff knows a lot more about that sort of stuff than I do: I'm just an interested spectator; he's a licensed peace officer. :)
